Digital Millennium Copyright Act (DMCA) Policy
In accordance with the Digital Millennium Copyright Act (DMCA), Marylebone DIY has adopted the following policy regarding copyright infringement. We reserve the right to:
- Block access to or remove material that we believe is copyrighted and illegally copied and distributed by any of our advertisers, affiliates, content providers, members, or users.
- Remove and discontinue service to repeat offenders.
Please note that your use of Marylebone DIY services is always subject to our Terms of Service, which includes this Copyright Dispute Policy. Any terms used in this policy without being defined will have the meanings provided in the Terms of Service.
Procedure for Reporting Copyright Infringements
If you believe that material residing on or accessible through our services infringes your copyright (or the copyright of someone you are authorized to act on behalf of), please send a notice of copyright infringement to our Designated Agent to Receive Notification of Claimed Infringement (our "Designated Agent"). The notice should include the following information:
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner who has allegedly been infringed;
- Identification of the copyrighted work or materials that are being infringed;
- Identification of the material that is claimed to be infringing, including sufficient information to locate and verify its existence on our service;
- A statement that the notifier has a good faith belief that the material is not authorized by the copyright owner, its agent, or the law;
- Contact information for the notifier, including address, phone number, and, if available, email address;
- A statement made under penalty of perjury that the information provided is accurate and that the notifier is authorized to file the complaint on behalf of the copyright owner.
Upon Receipt of a Proper Copyright Infringement Notification
Upon receipt of a valid copyright infringement notice, Marylebone DIY reserves the right to:
- Remove or disable access to the infringing material;
- Notify the content provider accused of infringement that the material has been removed or access to it disabled;
- Terminate the access of repeat offenders to the service.
Procedure to Provide a Counter-Notice to the Designated Agent
If the content provider believes the material removed (or to which access was disabled) is not infringing, or if they have the right to post and use such material, they may send us a counter-notice to the Designated Agent. The counter-notice should include the following:
- A physical or electronic signature of the content provider;
- Identification of the material that was removed or to which access was disabled, including the location of the material before it was removed or disabled;
- A statement that the content provider has a good faith belief that the material was removed or disabled due to a mistake or misidentification of the material;
- The content provider’s name, address, phone number, and, if available, email address;
- A statement that the content provider consents to the jurisdiction of the court for the judicial district in which the content provider’s address is located, or, if the address is outside the United Kingdom, for any judicial district where Marylebone DIY is located, and that they will accept service of process from the person who filed the original infringement notification.
If we receive a counter-notice, we may, at our discretion, forward a copy of it to the original complaining party and inform them that the material will be restored or access will be reinstated in 10 business days unless the copyright owner files a court action against the content provider.
